1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding contract between you ("User", "Client", or "Developer") and GoSMS ("we", "us", operating at https://gosms.in). By registering an account, integrating our developer APIs, or recharging wallet balance, you agree to abide by these Terms, along with our Privacy Policy and Refund & Cancellation Policy.

2. Service Offerings & Telecom Routing

GoSMS provides high-speed enterprise SMS gateway connectivity, authentication alert pipes, and developer REST APIs. Our services include:

• DLT Compliant Enterprise Routes: Transactional, OTP, and service messages strictly mapped to registered Principal Entity IDs, Header Sender IDs, and Content Templates as mandated by the Telecom Regulatory Authority of India (TRAI).
• Non-DLT Instant Open Routes: Fast-track messaging pipelines enabling developers and startups to send high-throughput notifications, global alerts, and transactional messages without upfront template approvals.
• Developer REST APIs & Webhooks: Single-endpoint HTTP APIs with sub-50ms server response times and live delivery status webhooks.
• Whitelabel Reseller Tier: Multi-tier reseller portal management with custom domains and wholesale pricing margins.

3. User Obligations & Anti-Spam Acceptable Use Policy

GoSMS enforces a strict Zero-Tolerance Policy against spam, fraud, and unlawful communications. You agree NOT to transmit:

• Phishing, lottery scams, unauthorized financial solicitations, or deceptive impersonation.
• Unsolicited commercial broadcasts in violation of TRAI TCCCPR regulations.
• Harassing, defamatory, obscene, or threatening content under the Indian IT Act, 2000.
• Malicious links, viruses, or unverified URL shorteners designed to mislead recipients.

Any violation results in immediate account termination, forfeiture of remaining wallet balance, and reporting to legal and regulatory authorities.

4. Pricing, Wallet Recharges & GST Billing

All services operate on a prepaid wallet model in Indian Rupees (INR). Recharges are processed instantly via automated UPI QR codes and authorized payment gateways. Wallet balance credits have Lifetime Validity and never expire. Standard GST (Goods & Services Tax) is levied transparently during recharges.

5. Delivery SLA & Latency Disclaimers

While GoSMS targets 99.99% uptime and sub-2 second delivery speed, final handset receipt depends on upstream telecom network operators (Airtel, Jio, Vi, BSNL) and handset availability (device active, network coverage, DND status).

6. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of the competent courts in Kolkata, West Bengal, India.
